Terms of Service
Last updated: October 20, 2026
These Terms of Service (“Terms”) apply to your use of flying411.com and to every purchase made through it. Please read them carefully.
Words used in these Terms
| Word | Meaning |
|---|---|
| Flying411, we, us | The operator of flying411.com. |
| You | Anyone who uses the site, with or without an account. |
| Buyer | Someone who buys, or tries to buy, an item through the site. |
| Seller | A business that lists items on the site. |
| Listing | An item a seller offers on the site. |
| Order | One online purchase of one item, with its own reference number (for example F411-E-2026-000123). |
| Protected Payment | How we handle payment on online orders of $5,000 and under (section 7). |
| Escrow purchase | An online order of more than $5,000 (section 10). |
| Stripe | Stripe, Inc. and its affiliates, the payment company we use. |
1. Who we are and what Flying411 is
1.1 Flying411 operates the website flying411.com. You can reach us using the contact details in section 22.
1.2 Flying411 is an online marketplace. Independent sellers list aircraft, engines, aircraft parts and other aviation items. We are not the seller of any listed item. We do not own, inspect, store, test, ship or certify items, and we do not check that a listing is accurate, that an item is airworthy, or that its paperwork is genuine.
1.3 The sale is a contract between the buyer and the seller. When you pay online, we run the payment steps described in sections 6 to 10 through our payment processor, Stripe. That does not make us a party to the sale.
2. Agreeing to these Terms
2.1 By creating an account or using Flying411, you agree to these Terms. If you use Flying411 for a business, you agree for that business and confirm you have authority to do so.
2.2 Before every online purchase you must tick a box agreeing to these Terms. The purchase cannot start without it. We record which version you agreed to, the date and time, and the internet (IP) address you used.
2.3 Our Privacy Policy also applies. Sellers who take payments online also agree to Stripe's terms (section 12.1).
3. Accounts and eligibility
3.1 You must be at least 18 years old and able to enter into a binding contract.
3.2 Give true, complete information and keep it up to date. Keep your password secret. You are responsible for everything done through your account, including by team members you give access to.
3.3 There are two kinds of account:
- Buyer accounts (called “client” accounts on the site). Online purchases are made from these.
- Seller accounts (called “vendor” accounts). Only these can sell online. A seller account cannot buy online, and nobody can buy their own listing.
3.4 We may review, approve, suspend or close any account (section 18). An account that is not active cannot sign in, buy or sell. If a seller's account is switched off, its listings can no longer be bought online.
4. Listings
4.1 If you list an item, you promise that:
- you own it or have the right to sell it;
- the description, condition, photos, price and quantity are accurate and current;
- any paperwork you describe exists and is genuine; and
- the item may be lawfully sold and shipped (section 15).
4.2 Moderation. We review listings. Only approved listings are shown and can be bought. We may reject or remove a listing at any time.
4.3 Which listings can be bought online. Only a listing that is:
- an engine or an aircraft part (aircraft are contact-only);
- priced in US dollars;
- at a fixed price (no price label, or the label “Sale Price”). Listings marked “Call for price”, “Request quote”, “Make an offer”, “Starting bid”, “OBO” or with any other price label are contact-only; and
- in stock, not sold, and from an active seller whose Stripe account Stripe has not refused (section 12.1).
All other listings are “Contact Seller”: the buyer and seller deal with each other directly, and Flying411 takes no part in the payment.
4.4 Each online order is for one unit.
4.5 Price changes. The price on an order is fixed when the buyer starts checkout. If the price changes while the buyer is on the checkout page, the purchase is refused and the buyer is shown the new price.
5. Prohibited items and conduct
5.1 You must not list, sell or buy:
- stolen items, or items you do not have the right to sell;
- counterfeit parts, or parts you suspect are not approved for use;
- parts with false, altered or missing paperwork that the listing says exists;
- items whose export needs a licence or approval you do not have (section 15);
- hazardous materials that cannot be shipped lawfully; or
- anything else that is illegal to sell or ship.
5.2 You must not:
- post false, misleading or duplicate listings, or impersonate anyone;
- use the site for fraud, harassment or spam;
- copy the site or collect its data by automated means (scraping, bots, crawlers) beyond what our robots.txt allows, or interfere with how the site works; or
- try to get around a payment step, a fee or a safety check.
6. Buying online: what you pay and how
6.1 Two ways to pay, by price:
| Price | How it works |
|---|---|
| $5,000 and under (including exactly $5,000) | Protected Payment: the whole price by card (section 7). |
| Over $5,000 | Escrow purchase: a card deposit plus a bank wire to an escrow agent (section 10). |
The price that decides the tier is the price you pay, as described in section 6.3.
6.2 Payment method. Online purchases are paid by credit or debit card. Card details go straight to Stripe; Flying411 never sees or stores your full card number. Payment methods shown at checkout as “coming soon” are not yet available.
6.3 Price. You pay the price shown at checkout. For parts and engines, that price includes Flying411's fee of 5% on top of the seller's own price (section 12.4). On orders of $5,000 and under nothing else is added at checkout. On escrow purchases the escrow fee is added (section 10.1).
6.4 Shipping is not included. Shipping is arranged between you and the seller and is not part of the price you pay online.
6.5 Taxes and duties. Flying411 does not currently calculate or collect sales tax, VAT, customs duty or import tax. You are responsible for any taxes, duties and import charges due on your purchase.
6.6 Ship-to address. At checkout you must give a complete ship-to address and a phone number the carrier can call. It is saved on the order and cannot be changed once your card is held. The seller sees it only after your payment is secured.
6.7 Reservation. When you start checkout, the item is reserved for you. If you do not finish paying within 30 minutes, the reservation ends and the item goes back on sale.
6.8 We may refuse a purchase, for example if the item has just sold or changed price, if the seller cannot currently be paid, if your account is not active, if too many purchases are started from one account or address in a short time, or if online buying is switched off (section 14.3).
7. Protected Payment (orders of $5,000 and under)
“Protected Payment” is our name for how we handle payment on these orders.
7.1 Card hold. When you pay, your card is authorized for the full price: held, not charged.
7.2 The seller has 72 hours from the hold to confirm the item is still available. If the seller declines, or does not answer in time, the order is cancelled, the hold is released and you are charged nothing. How quickly a released hold disappears from your statement is up to your card issuer.
7.3 You may cancel from your order page at any time before the seller confirms. The hold is released and you are charged nothing. After the seller confirms you cannot cancel on your own; contact us.
7.4 Charge. After the seller confirms, a member of our team charges your card for the full price. A card hold lasts about 7 days. If it ends before we charge it, we may cancel the order; you are charged nothing and may order again.
7.5 Once your card is charged, the item is taken off sale and the seller is told to ship.
7.6 Shipping. The seller ships to the address on the order and enters the carrier and tracking number. We pass the tracking number to you.
7.7 Delivery. Our team records the delivery after checking the carrier's tracking, your own confirmation, or a signed proof of delivery. Your 48-hour inspection window starts when we record the delivery, not when the carrier delivered. The 48 hours are real elapsed hours, whatever the time zone or daylight-saving change.
7.8 During the 48 hours you can:
- confirm the item arrived as described, which ends the window early; or
- report a problem (section 8).
If you do nothing, the item counts as accepted when the window ends, and the payout to the seller is queued. Until a member of our team approves that payout, the site still lets you report a problem and we will review it.
7.9 When the seller is paid. Only after the window has ended (or you confirmed) with no open problem, and only when a member of our team approves the payout. Nothing is paid to the seller before delivery.
7.10 Where your money is. Your payment is processed by Stripe and held in Flying411's account with Stripe until it is paid to the seller or returned to you. You are not paid interest on it.
7.11 What Protected Payment is not. It is not an escrow service, not insurance, and not a warranty about the item. It means only what this section says.
8. If something is wrong with your order
8.1 Report a problem from your order page, or from the link in our email, within the 48-hour window (and in any case before the payout is approved). You must describe the problem; a report with no description is refused.
8.2 Photos. Please attach photos of the item and the packaging: up to 5 photos (JPG, PNG or WebP, up to 10 MB each). You can add more until the claim is resolved. Nobody can delete a claim photo, including you. Our team and the seller can see them, so do not include your address label or anything else private.
8.3 While a claim is open the payment stays held and the payout is stopped. Keep the item in the condition and packaging it arrived in until the claim is resolved.
8.4 Review. Our team looks at the evidence from both sides and contacts you. There is no fixed deadline for a decision.
8.5 Outcome. We either pay the seller, or refund you in full to the card you paid with (and, for escrow purchases, the escrow agent wires back any balance they received).
8.6 If your item did not arrive, contact us (section 22) and we will look into it.
8.7 Chargebacks. Please contact us before disputing a charge with your card issuer. If you do dispute it, the order is frozen: we cannot pay or refund it through the site while the dispute is open, and the result follows the card issuer's decision.
9. Cancellations and refunds at a glance
| What happens | When | Result for the buyer |
|---|---|---|
| You do not finish paying | Within 30 minutes of starting checkout | Reservation ends; no charge. |
| You cancel | Before the seller confirms | Hold released; no charge. |
| The seller declines | Before confirming | Hold released; no charge. |
| The seller does not answer | 72 hours after the hold | Order cancelled; hold released; no charge. |
| We cancel after charging | Before the item ships | Full refund to your card (escrow purchases: see 10.8). |
| Your claim is upheld | After delivery, before payout | Full refund to your card (escrow purchases: see 10.8). |
| No claim, or claim not upheld | After the window | The seller is paid. |
9.1 Refunds go back to the card you paid with. We start the refund when the decision is made; your card issuer decides when it appears on your statement.
9.2 We may cancel an order before the item ships if we believe it is necessary, for example because of suspected fraud, a legal or sanctions concern, or a listing error. If your card has already been charged, you receive a full refund.
10. Purchases over $5,000 (escrow purchases)
Escrow purchases are available only once our escrow service is open. Until then, checkout refuses purchases over $5,000, and you can contact the seller directly.
10.1 Deposit and escrow fee by card. At checkout your card is authorized for a deposit of 5% of the price, capped at $5,000 (the cap is reached at a $100,000 price), plus the escrow fee in the table below. The deposit counts toward the price; the escrow fee is paid on top of the price. Example: for a $40,000 engine your card is authorized for $2,300 (the $2,000 deposit and the $300 escrow fee), and you wire the $38,000 balance, $40,300 in all.
| Item price | Escrow fee |
|---|---|
| $5,001 – $10,000 | $125 |
| $10,001 – $20,000 | $200 |
| $20,001 – $40,000 | $300 |
| $40,001 – $70,000 | $400 |
| $70,001 – $100,000 | $500 |
| $100,001 – $150,000 | $700 |
| $150,001 – $200,000 | $900 |
| $200,001 – $400,000 | $1,200 |
| $400,001 – $600,000 | $1,500 |
| $600,001 – $1,000,000 | $2,000 |
| $1,000,001 – $2,000,000 | $3,000 |
| $2,000,001 – $5,000,000 | $4,000 |
| $5,000,001 – $10,000,000 | $5,000 |
| $10,000,001 – $20,000,000 | $7,500 |
| Over $20,000,000 | $10,000 |
Each band includes its top figure; anything above it, even by a cent, is in the next band. The fee is fixed when you start checkout. There is no escrow fee on purchases of $5,000 and under.
10.2 Hold and seller confirmation. The deposit and fee are first held on your card, not charged. The seller has 72 hours to confirm, and you may cancel before they do, exactly as in sections 7.2 and 7.3.
10.3 Charge. After the seller confirms, our team charges the deposit and the escrow fee to your card.
10.4 Wire the balance to the escrow agent, a licensed attorney who holds the wired balance for escrow purchases:
- the bank details are shown only on your order page, after you sign in. We never send bank details by email (section 11);
- our escrow team will telephone you to read the details back before you send anything;
- put your order reference on the wire; and
- the amount that arrives must equal the balance exactly. Any charges your bank or an intermediary bank takes must be paid on top. Our team cannot record a wire of any other amount.
If the balance does not arrive, we may cancel the order. Your deposit and escrow fee are then refunded to your card.
10.5 When the escrow agent confirms receipt and our team records it, the item is taken off sale and the seller is told to ship.
10.6 Shipping, delivery, the 48-hour inspection window and claims work exactly as in sections 7.6 to 8.
10.7 Payout. After the window ends with no open problem and our team approves the payout, we pay the seller through Stripe and the escrow agent wires the balance to the seller.
10.8 Refunds. The deposit and the escrow fee go back to your card. If the escrow agent received your wire, they wire the balance back to you.
10.9 Who holds what. The card deposit and escrow fee are held in Flying411's account with Stripe, as in section 7.10. The wired balance is held by the escrow agent.
11. Wire fraud warning
11.1 We never send bank account details by email, and we never change them once given. Any email that shows bank details for a Flying411 purchase is fake, however genuine it looks. Do not act on it. Call us on the number on our website, not one in the message.
11.2 Sellers never receive a buyer's wire directly. If a buyer says they were emailed your bank details, tell us straight away.
11.3 We are not responsible for money sent to any bank account other than the one shown on your order page and confirmed by our phone call.
12. Seller terms
12.1 Getting paid online
- Your listings that meet section 4.3 get a Buy button whether or not you have connected a Stripe account. To be paid for an online sale you need a connected Stripe account that Stripe says can be paid: until then the sale goes ahead and your payout waits. If Stripe refuses your account, your listings are “Contact Seller”.
- You connect from your dashboard (“Connect with Stripe”). Stripe opens a Stripe Express account for you and collects your identity, business and bank details on Stripe's own pages.
- For now, only businesses based in the United States can connect.
- Flying411 does not receive your bank account or identity details. From Stripe we receive whether your account can be paid and the business name, email and country on the account.
- One payout account per seller. You can connect your first account yourself. Any change must be made by our team. If your payout account changes while you have orders in progress, payouts on those orders are held until our team has reviewed the change.
Payment processing services for sellers on Flying411 are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to these Terms or continuing to operate as a seller on Flying411, you agree to be bound by the Stripe Services Agreement, as the same might be modified by Stripe from time to time. As a condition of Flying411 enabling payment processing services through Stripe, you agree to provide Flying411 accurate and complete information about you and your business, and you authorize Flying411 to share it and transaction information related to your use of the payment processing services provided by Stripe.
12.2 What you must do when you make a sale
- Confirm or decline within 72 hours. Decline only if the item is truly no longer available. If you do not answer, the order is cancelled. After a decline, that listing loses its Buy button until you update it.
- Do not ship until we tell you the buyer's payment is secured (our “Ship now” email, and the order shows it). The buyer's address is shown to you only then.
- Ship only to the address on the order. Enter the carrier and tracking number. Pack the item properly and include the paperwork your listing describes. Keep your packing and dispatch records.
- If the buyer reports a problem, cooperate with our review. If a claim is upheld because the item was mis-described or faulty, return shipping is at your cost.
12.3 Payouts
- You are paid after the buyer's inspection window ends with no open problem (or the buyer confirms), and only when a member of our team approves the payout.
- We transfer the money to your Stripe account. Stripe then pays it to your bank on your Stripe payout schedule.
- On escrow purchases, we pay you through Stripe and the escrow agent wires you the balance.
12.4 Fees
Flying411's fee on parts and engines. Buyers see and pay your price plus 5% on every part and engine bought online. Flying411 keeps the 5%, and you are paid the price you set: a part you list at $1,000 shows buyers $1,050, and you receive $1,000. The $5,000 line and the escrow fee go by the price buyers see.
Escrow fee. On escrow purchases the buyer pays the escrow fee, on top of the price (section 10.1). Nothing comes off your payout for it.
12.5 Money you owe back (refunds, chargebacks)
- If a buyer is refunded, or wins a chargeback, after you have been paid, you must repay that amount to Flying411.
- You authorize us to recover it by reversing the transfer to your Stripe account or by invoicing you.
- While a chargeback is open on an order, its payout is frozen.
12.6 Taxes
You are responsible for your own taxes on your sales and income. Flying411 does not currently collect or pay sales tax for you.
13. Disputes between buyers and sellers
13.1 The sale is between buyer and seller. Please try to sort out problems directly first.
13.2 For online orders, our claims process decides only what happens to the money held for that order: pay the seller, or refund the buyer. It does not decide your other legal rights against each other.
13.3 To resolve a claim we may share with the other party the information needed for it, such as claim photos, tracking details and the order history.
13.4 For “Contact Seller” deals, Flying411 takes no part in the payment. For large purchases we recommend a trusted escrow provider.
14. Our role and the limits of our liability
14.1 Flying411 is provided “as is” and “as available”. We make no promise that listings are accurate, that items are as described, airworthy or legal to own or export, or that a buyer or seller will perform.
14.2 We are not responsible for the acts or failures of buyers, sellers, carriers, card issuers, Stripe or the escrow agent.
14.3 We may switch online buying off at any time. New purchases then stop. Orders already in progress carry on: charges, refunds, released holds and payouts still happen as described above.
15. Export control and sanctions
15.1 Aircraft parts and engines can be controlled under US export laws (including the Export Administration Regulations and the International Traffic in Arms Regulations) and US sanctions. You are responsible for complying with them. Do not list, sell, buy or ship an item you cannot lawfully export, receive or re-export.
15.2 Online checkout does not ship to Cuba, Iran, North Korea, Syria, Russia or Belarus. The site cannot detect sanctioned regions inside other countries (for example Crimea or the so-called Donetsk and Luhansk People's Republics); shipping there is forbidden under these Terms all the same.
15.3 You may not use Flying411 if you are on a US government restricted-party list, or act for someone who is.
16. Communications
16.1 We send emails about your account and your orders as part of the service. Order emails on Protected Payment orders come from “Flying411 Orders”.
16.2 Calls and text messages are covered by section 6 of our Privacy Policy. In short: we call or text you only if you opted in by ticking the consent box on a form; reply STOP to stop texts; message and data rates may apply; and consent is not a condition of purchase.
16.3 Escrow purchases: our escrow team will telephone you to confirm the wire details before you send money. This call is part of the purchase you asked for.
17. Privacy
How we handle personal information is set out in our Privacy Policy. Online payments add the following:
- your ship-to address and phone number, saved on the order;
- claim photos, seen by our team and by the seller; they cannot be deleted;
- a record of each acceptance of these Terms (version, date and time, IP address);
- for sellers, the account status and the business name, email and country Stripe tells us (section 12.1); and
- a history of every step of each order and who took it.
Stripe processes the payment information you give it as described in the Stripe Privacy Policy.
18. Suspension and closing accounts
18.1 We may suspend or close an account, or remove listings, if we believe these Terms have been broken, for fraud or safety reasons, or if the law requires it.
18.2 You may close your account at any time by contacting us.
18.3 Anything you owe us (section 12.5) and sections 13 to 15 and 20 continue to apply after an account is closed.
19. Changes to these Terms
19.1 We may change these Terms. We will post the new version on this page with its date.
19.2 The Terms in force when you start checkout apply to that order. We record the version you accepted on the order. The price, the $5,000 threshold, the deposit percentage and cap, the inspection window and the escrow fee are fixed on the order when it is created; a later change does not alter an order already made.
20. Governing law and disputes with Flying411
20.1 These Terms are governed by the laws of the State in which Flying411 is organized and by the federal laws of the United States that apply.
20.2 If you have a concern or a dispute with Flying411, please contact us first (section 22) so we can try to resolve it informally.
21. General
21.1 If any part of these Terms is found to be unenforceable, the rest of these Terms stays in effect.
21.2 If we do not enforce a part of these Terms straight away, we have not given up the right to enforce it later.
21.3 We may send you notices by email to the address on your account, or by posting them on the site. You can send notices to us using the contact details in section 22.
